Any inspection or additional information made available through Hamrobazar is provided for the Bidder's information and does not constitute an independent inspection, authentication or guarantee by Hamrobazar. The Seller or respective Team remains responsible for the authenticity, ownership, condition, description and other representations relating to the Lot, subject to the rights and remedies expressly provided under these Terms and Conditions.

8.3 Ownership and Authenticity. The Seller confirms that it owns the Lot or has authority to sell it and that material authenticity claims are supported by appropriate evidence.

8.4 Used or As-Is Lots. A Lot may be sold in used or "as-is" conditions where disclosed. This does not exclude remedies for counterfeit goods, lack of authority, material misdescription, fraud, or non-delivery.

9. Auction Format and Timing

9.1 Format. Unless otherwise stated, the Auction is a timed ascending auction in which Bids increase according to the published bidding rules.

9.2 Auction Clock. The Hamrobazar auction clock determines the opening, bid receipt, extensions, and closing time.

9.3 Timing. The Auction will open and close at the published time. Bids submitted before the official opening time and after the closing will not be accepted.

9.4 Live Display. Hamrobazar will use reasonable efforts to display the current leading Bid. The authoritative Bid record and acknowledgement will prevail in case of a display delay.

10. Starting Price, Reserve and Bidding

10.1 Starting Price. The starting price is the opening Bid amount and may differ from the Reserve.

10.2 Reserve Price. The Auction Details page will state whether a Reserve price applies and, where applicable, whether the Reserve amount or only its status is displayed.

10.3 Reserve Protection. The Reserve will be set before the Auction opens and will not be changed after the first valid Bid except through a valid cancellation and restart.

10.4 Bidding Increments. Each Bid must meet the published minimum increment or next-Bid rule.

10.5 Equal Bids. Where equal Bids are permitted, priority will normally follow the earliest authoritative receipt of time or the published proxy-bidding rule.

10.6 Currency and Charges. Bids are made in the currency stated in the Auction Details page. No additional buyer premium, platform fee or other charges will apply beyond the delivery charges and applicable tax disclosed in the Auction Details page.

The Buyer shall be responsible for paying all applicable delivery, customs, duties, taxes or other charges associated with delivery outside Nepal and shall coordinate with the designated logistics provider and provide any information or documentation required to facilitate such delivery. The Buyer shall not refuse or delay delivery due to such charges.

11. Bid Submission and Binding Effect

11.1 Submission. A Bid becomes an accepted Bid only when recorded by the authoritative auction system and acknowledged by Hamrobazar.

11.2 Binding Bid. An accepted Bid is a binding and ordinarily irrevocable offer to purchase the Lot at that amount under the applicable Auction Details page.

11.3 No Immediate Sale. An accepted or leading Bid does not itself complete the sale. Sale formation is governed by Section 13.

11.4 Bid Records. The Bidder should retain the Bid acknowledgement and promptly report any suspected error or unauthorized activity.

11.5 Outbid Notices. The Hamrobazar platform and the relevant Auction page shall remain the primary and authoritative source for current Bid status, including whether a Bidder has been outbid. Bidders are responsible for checking the Auction page for the latest Bid status.

12. Bid Correction and Invalid Bids

12.1 No Change of Mind. A Bid cannot normally be withdrawn because the Bidder changes their mind, finds another Lot or is unable to obtain financing.

12.2 Correction. Hamrobazar may consider a prompt correction request involving a genuine input error, account compromise, or verified platform error.

12.3 Invalid Bids. Hamrobazar may invalidate a Bid for reasons including ineligibility, false identity, prohibited connections, shill bidding, collusion, payment fraud, technical error or other material breach.

12.4 Fair Treatment. Any invalidation will be recorded and will not be used to favour a particular Bidder or Seller.

13. Winning Bid and Sale Formation

13.1 Provisional Winner. At final close, the highest valid Bid that meets the Reserve becomes the Provisional Winning Bid, subject to final validation.

13.2 Validation. Hamrobazar may validate eligibility, bid records, Deposit, Reserve, payment status and material integrity concerns before confirming the outcome.

13.3 Winning Bid Confirmation. Once validated, Hamrobazar will issue a Winning Bid Confirmation stating the Lot, Seller, winning price, applicable charges, payment deadline and fulfilment information.

13.4 Contract Formation. Unless the Auction Details page state otherwise, the sale of contract between the Seller and Winning Bidder is formed when the Winning Bid Confirmation is issued.

13.5 Objective Rejection. A Provisional Winning Bid may be rejected only for an objective eligibility, Reserve, integrity, legal or material technical reason.

13.6 Next Bidder. If the Winning Bidder defaults, the Lot may be offered to the next-highest eligible Bidder in descending order of valid bids, subject to acceptance and payment within the stated period.

14. Price, Fees and Payment

14.1 Winning Price. The Winning Bid shall be the price of the Lot. Applicable VAT shall be included in the winning price, and the total amount payable shall be displayed to the Winning Bidder before payment, unless otherwise specified in the Auction Details.

14.2 Additional Charges. Any buyer premium, tax, delivery charges, or other applicable charge will be disclosed before bidding or calculated using a disclosed basis.

14.3 No Hidden Charges. No undisclosed price component will be added after the Auction closes, except for lawful variable charges calculated on the disclosed basis.

14.4 Payment. The Winning Bidder must pay the total amount due through the authorised payment method within the stated deadline.

14.5 Payment Confirmation. Payment is considered complete only when paid and confirmed through the authorized payment method. Screenshots or debit notifications alone do not constitute confirmation.

14.6 No Off-Platform Payment. You must not make payment to personal accounts, links or methods not expressly authorized on the Platform or Winning Bid Confirmation. Hamrobazar is not responsible for loss caused by a Bidder voluntarily paying an unauthorized third party, except to the extent caused by Hamrobazar’s own breach or security failure.

15. Deposit Release and Winning Bidder Default

15.1 Non-Winning Bidders. Eligible Deposits will be released or refunded after the Auction outcome is final, subject to the stated processing time in the Auction Detail page.

15.2 Provider Processing. Bank or payment provider processing may take additional time. Hamrobazar will provide available references and escalation information.

15.3 Investigation Hold. A Deposit may be held longer where reasonably required for a specific fraud, chargeback, identity or legal investigation and permitted by law.

15.4 Winning Bidder Default. Failure to make payment, complete required verification or otherwise complete the purchase without a lawful reason may constitute default.

15.5 Default Remedies. Following any required notice or cure period, the Deposit may be applied as disclosed. The Seller may also cancel or reoffer the Lot to other bidders and pursue other lawful remedies if required.

15.6 No Double Recovery. Hamrobazar and the Seller will not recover the same loss more than once.

16. Seller Withdrawal and Default

16.1 Lot Withdrawal. Once the Auction has opened and a valid Bid has been received, the Lot shall not be withdrawn solely because the bidding price is lower than expected.

16.2 Seller Non-Fulfilment. If the Team or applicable seller fails to complete the sale or deliver the Lot as described in the Auction Details, Hamrobazar may cancel the transaction and arrange a refund to the Winning Bidder, subject to these Terms and Conditions and applicable law.

16.3 Substitute Lot. No substitute Lot or material variation from the Lot described in the Auction Details shall be made without the Winning Bidder's consent, unless otherwise expressly disclosed in the Auction Details and permitted by applicable law.

17. Delivery, Collection and Ownership Transfer

17.1 Delivery and Fulfilment Terms. Delivery, collection or other fulfilment arrangements, including the applicable method, location, estimated timeline and charges, shall be as specified on the Auction Details page or otherwise communicated by Hamrobazar. The Winning Bidder shall provide accurate and complete information and comply with the applicable fulfilment requirements.

17.2 Delivery Timeline and Conditions. Delivery or collection shall be completed within the timeline specified on the applicable Auction Details page or as communicated by logistic partner. Unless otherwise stated, the applicable timeline shall commence upon confirmation of the required payment and completion of any applicable identity verification or other fulfilment requirements. Delivery or release may be subject to payment clearance, identity verification, and submission of valid contact and location information. Any material change to the stated delivery timeline shall be communicated to the Winning Bidder, as reasonably practicable.

17.3 Risk and Transfer of Ownership. Ownership of the Lot and the risk of loss or damage shall pass from the Team or other applicable seller of record to the Winning Bidder upon delivery of the Lot to and receipt by the Winning Bidder, subject to applicable law. Hamrobazar acts solely as a marketplace and auction platform and does not acquire ownership or title to the Lot merely by facilitating the Auction, payment or delivery.

17.4 Inspection and Reporting of Issues. The Winning Bidder shall inspect the package and Lot upon delivery or collection, where reasonably practicable, and is encouraged to retain clear photographs or videos of the package and Lot, including an unboxing video, as evidence of the condition of the package and Lot at the time of receipt. Any visible damage, missing items or material discrepancy should be reported to Hamrobazar Support within twenty-four (24) hours of delivery or collection, together with available supporting evidence. Hamrobazar may request additional information reasonably necessary to assess the reported issue. Failure to report an issue within this period shall not, by itself, exclude any rights or remedies available to the Winning Bidder under applicable law.

17.5 Collection and Delivery Attempts. The Winning Bidder shall cooperate with delivery or collection and shall not unreasonably refuse delivery or fail to receive or collect the Lot after being notified. If delivery or collection fails due to the Winning Bidder’s unavailability, incorrect information, refusal to receive the Lot or failure to comply with the applicable requirements, the Winning Bidder shall be responsible for any applicable additional delivery, redelivery, return, storage or handling charges. Hamrobazar reserves the right to take appropriate action in respect of any undelivered or uncollected Lot in accordance with these Terms and Conditions, the Auction Details and applicable law.

17.6 Address Changes.

(a) High-Value Auction Lots: The Winning Bidder may request an address change through Hamrobazar Support before the Lot is dispatched. Any change shall be subject to confirmation and approval, including confirmation that the revised address can be serviced by the designated logistics provider. No address change shall be permitted after dispatch, except where Hamrobazar and/or the designated logistics provider expressly permits it.

(b) Regular Merchandise and Mystery Deals: Address changes shall not be permitted after the order has been placed, unless Hamrobazar expressly approves an exception.

17.7 International Deliveries: In case of delivery outside Nepal, the Winning Bidder shall be responsible for coordinating directly with the logistics provider regarding delivery arrangements, required documentation, customs clearance and other applicable international delivery requirements. The Winning Bidder shall bear the applicable international delivery charges, customs duties, taxes and other related costs disclosed on the Auction Details page or otherwise lawfully payable by the Winning Bidder. Hamrobazar may facilitate communication with the logistics provider but shall not be responsible for undertaking such coordination on behalf of the Winning Bidder, except to the extent expressly agreed or required under applicable law.

18. Exchange Refunds and Remedies

18.1 Applicable Policy. Exchanges, cancellations, refunds and other remedies shall be governed by these Terms and Conditions, the applicable Auction Details page and applicable law.

18.2 Binding Bids. Bids are binding upon submission and may not be cancelled or withdrawn by the Bidder. Change-of-mind cancellations, returns or exchanges shall not be permitted after a Bid is accepted, and a Lot is won.

18.3 Claims and Exchange Requests. The Winning Bidder shall raise any claim or request for exchange or other remedy through Hamrobazar Support and provide valid supporting evidence as reasonably required. Hamrobazar shall review and verify the claim and, where the claim is considered valid, coordinate with the relevant Team or Seller of Record and facilitate communication between the parties to determine an appropriate resolution, including an exchange where appropriate and available, depending on the nature of the claim and the availability of a replacement Lot. Claims shall ordinarily be processed within two (7) to seven(7) working days, subject to the nature of the claim and any necessary verification or coordination. Any refund, or other remedy shall be subject to these Terms and Conditions.

18.4 Refunds. Where a refund is approved or otherwise required under applicable law, it shall ordinarily be processed through the original payment method, unless another lawful method is agreed or required. Refunds will generally be processed within two (2) to seven (7) working days, subject to the applicable payment method and payment provider's processing time. Where a refund becomes due under the applicable refund process, no separate request shall be required unless reasonably necessary to complete the process.

18.5 Auction Finality and Mandatory Remedies. Restrictions on cancellation, or exchange shall not exclude any mandatory rights or remedies available to the Winning Bidder under applicable law, including in cases involving counterfeit goods, lack of title, material misdescription or non-delivery.

18.6 Separate Payment Events. Refunds of the purchase price and release or refund of any Bidder Deposit are separate payment events and may be processed separately.

19. Special Lots

19.1 Signed and Authenticated Items. The Auction Details page will state the authentication basis and any supporting certificate or documentation provided.

19.2 Limited Editions. Any limited-edition claim will state the relevant edition of size, numbering or other basis for the claim.

19.3 Tickets and Experiences. The Auction Details page will state the organiser, date, venue, admission, transfer and applicable event-change rules. A specific athlete's appearance is guaranteed only where expressly promised.

19.4 Digital Lots. Digital Lots will state applicable platforms, region, compatibility, expiry, redemption and transfer restrictions.

19.5 Regulated or High-Value Lots. Additional title, registration, licence, inspection, tax or transfer requirements may apply where required by law or the nature of the Lot.

20. Fair Bidding and Prohibited Conduct

20.1 Shill Bidding. Bidders must not engage in shill bidding, collusion, bid suppression, bid rotation, bid shielding, false bidding, artificial price inflation, intimidation, manipulation of another Bidder, fraudulent payment activity or any other conduct intended to distort a fair Auction outcome.

20.2 Seller and Connected Persons. A Seller, its representatives, employees and persons acting on its behalf must not bid on the Seller’s own Lot to inflate price or demand. Hamrobazar may require disclosure of material connections and may invalidate connected-person Bids where necessary to protect Auction integrity.

20.3 Collusion. Bidders must not coordinate Bids, suppress competition, rotate winning positions, intimidate other Bidders or manipulate an Auction or later resale.

20.4 Bid Shielding. A Bidder must not place an intentionally excessive Bid and arrange its withdrawal or invalidation to benefit another person.

20.5 Monitoring. Hamrobazar may use Account, device, payment, network and behavioural information to detect prohibited activity and may invalidate Bids, suspend Accounts or cancel an Auction where appropriate.

20.6 Fraudulent Activity and Consequences If a Bidder is found to have engaged in any fraudulent, deceptive, manipulative, collusive or otherwise unlawful activity in connection with an Auction, Hamrobazar may suspend or terminate the Bidder's participation, invalidate any affected Bids, and cancel or reverse any affected Auction transaction. The Bidder's Deposit may be forfeited only where the forfeiture is expressly permitted under these Terms and Conditions, including Clause 6.6, and the applicable conditions for forfeiture have been satisfied. Any such action shall be proportionate to the circumstances and subject to any mandatory rights or remedies available under applicable law.

21. Automated Access and Security

21.1 Prohibited Automation. Bots, scripts, scraping, credential attacks, unauthorised interfaces, timing manipulation and other methods that disrupt the Auction or provide unfair access are prohibited.

21.2 Security Measures. Hamrobazar may use reasonable security measures such as rate limits, CAPTCHA, verification, bidding limits, and manual review.

21.3 Account Security. Bidders must protect their credentials and promptly report suspected Account compromise.

22. Bid Records, Privacy and Monitoring

22.1 Public Information. Public bid history may show masked Bidder identifiers, amounts and times but will not ordinarily disclose legal, payment or verification of information.

22.2 Records. Hamrobazar may retain Bid, eligibility, deposit, payment, integrity and communication records for lawful and operational purposes.

22.3 Information Sharing. Information may be shared with Sellers, payment providers, delivery providers, verification services, advisers or authorities where necessary and permitted by law.

22.4 Seller Use. Seller information received through an Auction may be used only for the Auction, sale, fulfilment, support and compliance purposes unless otherwise lawfully permitted.

23. Suspension, Pause, Cancellation and Restart

23.1 Grounds. Hamrobazar may suspend a Bidder, pause a Lot or cancel an Auction where necessary due to material legal, title, authenticity, safety, fraud, integrity, Seller, technical or disclosure issues.

23.2 Proportionate Action. Hamrobazar will seek to limit the impact of an issue on the affected Bid, Bidder, Lot or Auction where reasonably possible.

23.3 Restart. In the event of a technical failure, website disruption, or other system-related issue that materially affects the fairness or proper functioning of an Auction, Hamrobazar may cancel and restart the affected Auction. In such cases, the entire Auction shall restart with new opening and closing times, and all Bids placed before the restart shall be void and shall not be carried forward. Auction Details and the revised schedule shall be communicated to Bidders.

23.4 Cancellation. A cancelled Auction produces no winner. Eligible Deposits and payments will be released or refunded, subject to any lawful investigation hold.

24. Technical Issues and Communications

24.1 Bidder-Side Issues. Device, internet, browser, power, payment or notification problems do not ordinarily invalidate an otherwise properly operated Auction.

24.2 Platform Issues. If a material Platform failure affects fair bidding, Hamrobazar may pause, extend, cancel or restart the Auction as appropriate.

24.3 Unrecorded Bids. Hamrobazar will not treat an intended or attempted Bid as accepted unless it was recorded by the authoritative auction system.

24.4 Notice. Material pauses, extensions, cancellations, restarts or outcome changes will be communicated through the Platform, or registered contact details where reasonably possible.

25. No Sale and Post- Auction Offers

25.1 No Sale. No sale occurs where the Reserve is not met; there is no valid Bid, or the Auction is validly cancelled.

25.2 Post-Auction Offer. The Seller may make a separate post-Auction offer through an approved process stating the price and applicable terms.

25.3 No Automatic Obligation. A losing or below-Reserve Bid does not create an obligation to purchase after the Auction closes unless the Bidder separately accepts a post-Auction offer.

26. Intellectual Property and Team/Athlete References

26.1 Rights. Team names, league marks, athlete names, images, signatures, logos, and other intellectual property belong to their respective rights holders. Winning a Lot does not transfer those rights unless expressly stated.

26.2 Endorsement. An Auction or Lot associated with a team, league or athlete does not imply personal endorsement unless expressly stated.

26.3 Restrictions. Personal-use, resale, reproduction, ticket-transfer or licensing restrictions applicable to a Lot will be disclosed before bidding.

27. Support, Complaints and Grievance

27.1 Support Channels. Bidders may raise complaints through the Hamrobazar Support Team using the contact number or other designated communication channels published on the Platform. Bidders shall provide relevant information and supporting evidence, including photographs or videos where applicable, as reasonably required to assess the complaint.

27.2 Complaint Details. Complaints should include the relevant Auction ID, Lot ID, Bid or Order reference and a description of the issue, together with supporting evidence where available.

27.3 Complaint Review and Resolution. Complaints relating to a Lot, including damage, authenticity, misdescription or other fulfilment issues, shall generally be handled through the following process:

(a) Reporting: The Bidder shall report the issue to Hamrobazar Support within the applicable reporting period and provide valid supporting evidence, including photographs or videos where reasonably required.

(b) Verification: Hamrobazar shall review the complaint and supporting evidence to assess the validity of the claim and may request additional information where necessary.

(c) Coordination: Where the claim is considered valid and requires the involvement of the Team or relevant Franchise, Hamrobazar shall coordinate with the designated point of contact.

(d) Resolution: Hamrobazar shall facilitate communication between the Bidder and the relevant Team or Franchise, as appropriate, to assist in resolving the complaint in accordance with these Terms and Conditions and applicable law.

(e) Resolution Timeline: Claims shall ordinarily be resolved within seven (7) working days from confirmation of a valid claim, subject to the nature and complexity of the issue and any necessary coordination with the Team, payment provider, logistics partner or other relevant parties.

27.4 Escalation. If a complaint remains unresolved through the initial support process, the Bidder may request escalation through the designated Hamrobazar Support channels. Hamrobazar shall endeavour to acknowledge or escalate the complaint within twenty-four (24) working hours, where applicable.

27.5 Effect on Auction and Payment. Submission of a complaint shall not automatically suspend an Auction, payment or transaction. Hamrobazar may place an appropriate hold or take other reasonable measures where the complaint could materially affect the Auction outcome, transaction or available remedy, subject to applicable law.

28. Platform Disclaimer and Limitation of Liability

28.1. Hamrobazar operates solely as a technology-enabled intermediary digital platform facilitating the listing of Lots, registration of Bidders, submission and recording of Bids, administration of the auction process, payment facilitation and related support services. Unless expressly identified as the Seller of a Lot, Hamrobazar does not own, manufacture, supply or sell the Lot and is not responsible for the ownership, authenticity, provenance, condition, quality, description, legality, delivery or performance of any Lot, all of which remain the responsibility of the applicable Seller. Any information relating to a Lot, including claims that it is signed, match-worn, match-used, official, limited-edition or otherwise associated with any player, team, league or event, is based on information provided by the Seller or relevant rights holder unless expressly stated otherwise.

28.2. The Platform is provided using commercially reasonable care, but uninterrupted or error-free availability cannot be guaranteed. Where a material Platform error affects Auction fairness, Hamrobazar may use the corrective remedies in these Terms, including extension, pause, cancellation, restart, Bid invalidation or refund.

28.3 To the maximum extent permitted by Applicable Law, Hamrobazar shall not be liable for any loss, damage, claim, delay, failed or unrecorded Bid, interruption, technical failure, payment or delivery delay, Seller default, misdescription, authenticity dispute or other matter arising from or relating to the Lot, the Seller, any third-party service provider or the Bidder’s participation in an Auction.

28.4. Hamrobazar shall in no event be liable for any indirect, incidental, consequential, special, punitive or economic loss, including loss of profit, opportunity, goodwill or anticipated value. Nothing in this Clause shall exclude or restrict any liability or remedy that cannot lawfully be excluded under Applicable Law.

29. Bidder Responsibility and Indemnity

29.1 You are responsible for your eligibility, Account security, Bids, payment obligations and compliance with these Terms and the Auction Details.

29.2 To the extent permitted by law, The Bidder shall indemnify and hold harmless Hamrobazar, its affiliates, directors, officers, employees and representatives from and against any third-party claim, loss, liability, damage, cost or expense arising out of or relating to the Bidder’s breach of these Terms or applicable Auction rules, any false, misleading or unauthorized information provided by the Bidder, any fraud, collusion, shill bidding, payment fraud or other unlawful or prohibited conduct by the Bidder, the Bidder’s failure to complete a purchase after being confirmed as the Winning Bidder, or the Bidder’s violation of Applicable Law or third-party rights;

30. General Legal Term

30.1. Changes to these Terms: Hamrobazar may update these Terms for future Auctions to reflect legal, security, technical or business changes. Updated Terms will be published with a revised effective date.

30.2. Force Majeure: Neither Hamrobazar nor the Seller is responsible for delay or failure to the extent caused by an event beyond reasonable control, including natural disaster, fire, flood, epidemic, war, civil disturbance, government restriction, widespread telecommunications or payment-network failure, or similar event, provided the affected party takes reasonable steps to mitigate the effect. A force majeure event may justify pause, extension, rescheduling, cancellation or delayed delivery. It does not excuse a payment obligation already due unless performance of the underlying transaction is itself prevented or applicable law provides otherwise.

30.3. Severability: If any provision is found invalid or unenforceable, it will be applied to the maximum lawful extent, and the remaining provisions will continue in effect.

30.4. Assignment: A Bidder may not transfer an Account, Bid, Winning Bid or purchase obligation without Hamrobazar’s prior written consent and, where relevant, the Seller’s consent. Hamrobazar may transfer its rights and obligations as part of a lawful corporate reorganization or transfer of the relevant business, subject to applicable law and protection of Bidder rights.

30.5. Headings: Headings and the Key Auction Rules are for convenience and do not limit the operative provisions.

30.6. Governing Law and Dispute Resolution: These Terms, the Auction process and any sale formed through an Auction are governed by the laws of Nepal. The parties should first attempt to resolve a dispute through the Hamrobazar grievance process. If unresolved, the dispute may be brought before the competent consumer authority, regulator, court or other forum having jurisdiction under Nepalese law.
